1 Conclusion of the contract
1.1 If a user clicks on the relevant pop-up icon, it means that the user agrees to sign agreement with China Mobile Intelligent Mobility Ltd. (hereinafter referred to as "CMIM") based on this "terms and conditions". CMIM licensed users to paid or unpaid access to BMW RMI portal (at https://www.bmw-rmi.com.cn) which provided BMW vehicle repair and maintenance information (hereinafter referred to as "RMI information").
1.2 Change of this terms and conditions will be notified to the user. If the user clicks to accept the change or continue to access RMI portal after receiving the change, these changes will become terms of the contract. The license and terms of use as well as the rules and current information related to the RMI , and later the RMI portal publicity (including but not limited to Privacy, Imprint, instructions for use, user manuals, system prompts, etc.) has the same legal effect, constitute the complete agreement between CMIM and users. In case the relevant rules are inconsistent with the provisions of this agreement and the terms of use, the latest version shall prevail.
1.3 Payment within the scope of the contract will be made by RMB, by providing credit card number or other online payment methods.
1.4 The content of the contract involves the use of virtual items (e.g. RMI information).
2 Licensing
2.1 Subject to the following conditions, CMIM allows users to access RMI information:
2.1.1 The user has completed and sent the application form to the CMIM.
2.1.2 The user's location of business (for organization user) or the place of residence (for individual user) is within the region of China.
2.1.3 The user's relevant information has been reviewed by the website operator or the content responsible party.
2.1.4 The user has provided a valid credit card or online payment information for the payment of paid access to RMI information (applicable to paid RMI information).
2.2 After receiving license confirmation from CMIM, the user can log in RMI portal. For an organization user, the one applies for registration will be selected as the administrator of the organization. For an individual user, the one applies for registration will become the administrator of his (or her) account.
3 Usage fee
3.1 Users need to pay the following fee:
Access of applications, and some of the local contents will be charged, including but not limited to AIR, ISTA, ISTA-P, VIN structure, CCC information, Technical campaigns, Diagnosis, detection and maintenance devices and tools, Programming information. To be able to access to these information, the organization administrator and individual user (individual user cannot access programming information) must purchase the time credit first. When using the payment function, the user has the following options:
• 1 Day/s, (200.00 RMB)
• 1 Week/s, (1,000.00 RMB)
• 1 Month/s, (3,000.00 RMB)
The specific standard of the cost is listed in the RMI portal, CMIM has the right to modify it at any time according to the actual situation.
Users can only pay online.
One virtual account purchased by an organization can only be used by one user at the same time. The organization administrator can create individual users. Individual users must order their own time credit from the company's time quota before calling charging modules.
Both organization and individual users' account balance can be checked in the RMI portal related pages at any time.
3.2 The usage fee which listed in the RMI portal are including VAT.
3.3 RMI portal displays the latest status of the time balance to the user. They can access or use the information provided by the RMI only if the user have sufficient balance.
3.4 If the user proposes to terminate the contract, the unused balance will not refund.
3.5 For services that accessed by password, users will be required to pay the related costs.
3.6 After the user paid via credit card or other online payment methods successfully, CMIM will provide the paid RMI information immediately (response time depends on the system) to the user.
3.7 Users' payment to CMIM are not related to the result of information achieved, that is, if the information does not achieve the user's desired effect, the user cannot request a refund.
4 Using the information provided by the RMI
4.1 Users can only use the information which obtained from RMI portal to perform maintenance work in their workshop or to repair their own vehicle, but cannot provide parts or all RMI information to any other third party (including but not limited to the other entities within a group, associated companies, or other maintenance units within the maintenance plant) in any way (including sale, transferring, giving, publishing, distribution, dissemination or communication, etc.). If you are not a vehicle maintenance operator or consumer, please contact CMIM to obtain the appropriate service or information.
4.2 In the case of the RMI information being abused, CMIM can disable the user's account, or terminate the contract immediately. Moreover, the user has no right to request a refund of their unused balances, users should also compensate the total losses to CMIM, BMW or its related entities.
4.3 Information abuse, in particular refers to the user:
• Provide the RMI information to third parties in any way, or
• Store or copy with other unauthorized way, except using the print function on RMI portal to print the online screenshots.
4.4 In addition to the above terms, in order to access and use the RMI information, users also need to comply with the following terms and conditions:
• In the range of relevant laws and regulations, CMIM may suspend the dissemination of RMI information at any time on a reasonable ground, and the rights to recover, update, adjust or modify any RMI information;
• Users are not allowed to use the RMI information which obtained by this terms and conditions of use in any unauthorized way (including but not limited to their own, allow or assist third parties decompose, decode or reverse engineering any parts of the RMI information, or use RMI to engage in any illegal activities); and
• Users shall be responsible for the confidentiality of their own user name and password. They can only use it himself and may not provide them to others or allow others to use in any way. Each user shall take full responsibility for any and all activities that occur under his account, whether such activities are authorized by himself.
4.5 Users agree that their access and use RMI information must be comply with the terms and conditions. If CMIM considered that the user against any of the terms and conditions, CMIM has the right to terminate or suspend the user's access without prior notice to the user, and the user shall compensate total losses to CMIM, BMW or its related entities.
5 Safety information
The RMI information provided by RMI portal is intended to perform maintenance and repair work properly on standard and unmodified BMW vehicles. As a prerequisite for performing the work specified above, vehicle maintenance workers must receive the related training and regular further training. If RMI portal points out that they should use special tools, then it is absolutely mandatory in terms of professional maintenance and repair. Any risk caused by the incorrect use of RMI information according to the provisions is assumed by users themselves.
6 Disclaimer
6.1 Due to failing to comply with this terms and conditions,any risks caused by incorrect use of this license the use of terms is assumed by user themselves. All RMI information is provided as "based on current status", CMIM will update the RMI information base on the technical campaigns and other feedbacks, and mark or explain the updated information.CMIM, BMW or its associated entities are not responsible for the direct or indirect consequences of the users using non-up-to-date information.
6.2 Accessing RMI portal or obtaining the RMI information need Internet connection, CMIM doesn't ensure the privacy and security of the data transmitted over the Internet.
6.3 In any case,CMIM doesn't take any responsibility for the interruption of service, delay or omission caused by the failures of power, network, computer, communications or other system, and strikes, riots, insurrections, riots, fires, floods, storms, explosions, war, governmental behavior such as force majeure, international and domestic court order or third party as caused. CMIM reserves the rights to suspend the service due to system failure, upgrade and adjustment, and other reasons. In this case, CMIM will promptly announced on RMI portal or another place.

7 No authorization
The user has no right or authority to any RMI information provided by RMI portal, except for the limited rights to access and use the RMI information in accordance with this terms and conditions.
8 The term of the contractual relationship
The period of validity
If the users purchased the time credit of RMI information, then starting from the successful payment by credit card or other online method, the period of validity is the time they paid. If they want to terminate the contract, the user must send an email with the user number. CMIM has the right to prohibit user access RMI information at any time based on reasonable reason, the user rights resulting only as proportional refund of payments made by the user.
9 Law and Jurisdiction adapted
All legal disputes arising from or about this contract are subject to the law of People's Republic of China. The place of performance and the exclusive place of jurisdiction for all claims about this contract shall be ShangHai, China, unless otherwise specified by law.
10 Data protection
Users clearly agree CMIM to collect, process and use the information and data (including but not limited to personally identifiable data) which is provided in the process of users registration, using RMI portal or access RMI ; and agree CMIM to send your data to BMW and/ or BMW's overseas relevant entities for the services purpose, to provide you some related information, and improve the quality of service, etc. Users' data will be stored, processed and used in accordance with the relevant laws and regulations of China's personal information protection. The users can check their user data stored in RMI portal by clicking "Start -> My account", and may require the update, delete or disable the data when necessary.
11 Protection of Intellectual Property
All text, images, graphics, audio, animation and video as well as publishing in RMI portal (including but not limited to any RMI information) are protected by copyright and other protection laws. All users are only allowed to use them within the scope which expressly permitted by this terms and conditions, RMI portal, or other relevant rules. Copying, transmitting, altering or forwarding the content of a RMI web page to a third party or use it in any other way for commercial purposes are not allowed. Not allow to copy, distribution, modify or transfer the portal contents to a third party or in any other way for commercial. For exceptional cases, it needs the special written permission from both CMIM and BMW.
Unless otherwise indicated, all the BMW company or BMW vehicle related trademark on RMI portal are owned or held by BMW or its affiliated entities, and protected by trademark law and other relevant laws and regulations, including but not limited to brands, model names, icons, and logos.
Users should abide by relevant laws and regulations of China's intellectual property protection, shall not infringe the intellectual property of BMW or its affiliates or other entities for RMI information in any form; without the prior written authorization of BMW, the user shall not use RMI information for resale, publishing, or any other public or commercial purposes, or other purposes without explicit premised by this terms and conditions and other relevant rules on RMI portal.
12 Others
If one or more of this terms and conditions are invalid, the validity of the other provisions shall not be affected. In that case, the invalid provision shall be replaced by the economic objectives and the relevant functions of the provisions.
13 RMI portal structure, contents of paid and free access
In order to meet regulatory requirements, the following BMW RMI information has been formed.

7 No authorization
The user has no right or authority to any RMI information provided by RMI portal, except for the limited rights to access and use the RMI information in accordance with this terms and conditions.
